By entering the Promotion, participants agree to release, discharge and hold harmless DSI, its affiliates, subsidiaries, officers, directors, employees and agents from any and all damages, costs, expenses, and other liabilities, including damages for personal injury or damage to property, whether the damages are direct or indirect, and regardless of whether the claim is based on contract, tort or any other legal theory, which may be due to or arise out of participation in the Promotion or any portion thereof or the acceptance, use/misuse or possession of the prize.

 

By participating, you agree to these Official Rules and to all decisions of DSI being final and binding in all respects.

 

HOW TO ENTER:

 

IN PERSON ENTRY: Visit the DSI booth (2924) at 2011 FABTECH and complete an entry form. On the last day of the exhibit, November 17 at 1:00 pm, one entry will be drawn at random from all entries received to determine a winner. All completed entries must be fully completed on or before 12:00pm Central Standard Time on November 17, 2011 or they will be forfeited. 

 

MAIL-IN ENTRY: Any eligible individual wishing to enter the Promotion without attending the FABTECH 2011 show and DSI booth 2924 may do so by sending a 3"x5" card containing his or her name, address, telephone number and date of birth in a business size (#10) envelope addressed to: DSI – Bass Pro Shops Gift Card Giveaway Promotion, Centrifuge Brand Marketing, Inc., 245 East Madison Street, Lombard, IL 60148, Attn: KJ.  No entries will be accepted via fax, e-mail or by any other means other than by United States mail as set forth above. Mail-in entry requests must be postmarked after 9:00am Central Standard Time on November 1, 2011 and received no later than 9:00pm Central Standard Time on November 17, 2011. Sponsor assumes no liability for lost, delayed or misdirected mail. All entries submitted in accordance with mail-in rules will be pooled into the general drawings that will be held on November 17, 2011 at the FABTECH show.

 

Limit: One Entry Per Eligible Person.

 

PRIZES: One $200 Bass Pro Shops Gift Card.

 

PRIZE RESTRICTIONS: Winner will be required to complete and return an Affidavit of Eligibility and Liability Release. Prize may not be transferred or assigned. No cash or other substitution of a prize may be made, except by permission of the Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of equal or greater value. All costs related to acceptance and delivery of the prizes are the responsibility of the winner including but not limited to all taxes (including sales tax and all federal, state and local taxes). Winner may also be required to provide his/her Social Security number for tax reporting purposes. The Sponsor will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of the prize. Odds of winning the prize depend on the number of eligible entries received during the Sweepstakes Period.

 

SWEEPSTAKES DRAWING AND NOTIFICATION OF PRIZE WINNER: DSI will award prize only upon winner verification and final approval. The random drawing will be held on November 17, 2011. Decisions by DSI of winner eligibility, notification, and acceptance or disqualification will be final and binding. Prize winner will receive prize notification by one of the following methods: in-person at the drawing, telephone, email or certified mail.

 

The winner may be required to execute and return to DSI an Affidavit of Eligibility within ten (10) days following attempted notification.

 

If the selected winner has not complied with the Official Rules, cannot be contacted, is ineligible, the Prize Notification or prize is returned as undeliverable, or does not return the executed Affidavit of Eligibility and/or tax forms, if required, within the specified time period, an alternate winner will be selected. Acceptance of a prize constitutes permission for DSI to use winner's name and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law. All information collected will be treated in a manner consistent with DSI's privacy policy. All decisions of DSI shall be binding and final.

LIMITATIONS OF LIABILITY: DSI is not responsible for any typographical or other error in the printing or advertising of the offer, administration or execution of the contest or in the announcement of the prizes/prize winners. By accepting a prize, the winner agrees to hold DSI, its employees, directors, officers, shareholders, agents, representatives, subsidiaries, parents, affiliates, predecessors, successors and assigns (collectively “Releasees”), harmless and release them from any and all liability arising out of any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this contest, or the acceptance, possession or use/misuse of any prize, or participation in any prize-related activities (including but not limited to travel related thereto), and to assume all liability in connection therewith. Releasees shall not be liable to any winner, entrant or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Releasees’ sole control. No more than the advertised maximum number of prizes will be awarded for any reason.

 

CONDUCT: DSI reserves the right, at their discretion, to disqualify anyone found to be tampering with the entry process or the operation of the Promotion or Website hosting the Promotion, to be acting in violation of the Official Rules, to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS. GENERAL INFORMATION: This promotion is conducted in English (which will be given its everyday ordinary meaning) and any and all disputes will be resolved in the appropriate courts in the State of Wisconsin in the United States, exclusively, and subject to the laws of the State of Wisconsin. Should there be a conflict between the laws of the State of Wisconsin and any other laws, the conflict will be resolved in favor of the laws of the State of Wisconsin.
